Setster Privacy Policy

1. Introduction
As part of our mission, Setster Inc. DBA Setster, owns and provides various tools that facilitate online scheduling of appointments (collectively, "Setster") collect and process a lot of information. This Privacy Policy is intended to help you understand how we collect, use and store your personal information.
Whether you are a ("Customer") that uses Setster’s products, applications or services (together, the "Services"), a ("Client") that books an appointment with a Customer, using our technology, or you’re simply a ("Visitor") visiting this website, you are agreeing to the terms of this Privacy Policy and as applicable, the Setster Terms of Service.
We may update this Privacy Policy from time to time in order to reflect changes to our privacy practices or for other operational, legal, or regulatory reasons. If we make material changes to this Privacy Policy, we will give you notice of such changes by posting the revised policy on this Website. By continuing to use this website or the Service after these changes are posted, you agree to the revised policy.
2. Information from Customers
"Customer" refer to any business, entity or person that registers to use or try the Setster Services, whether paid or unpaid. This also includes all Users created within the account a Customer creates on the Setster Service.
If you are a Customer, your Clients need to understand how you (and how Setster) collects and processes their personal information. Accordingly, if you use the Services, you agree to post an up-to-date and accurate privacy policy on your booking page that complies with the laws applicable to your business. You also agree to obtain consent from your Clients for the use and access of their personal information by Setster and other third parties. In addition, if you are collecting any sensitive personal information from your Clients (including information relating to medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or sexuality), you agree to obtain affirmative, express consent from your Clients for the use and access of sensitive personal information by Setster and other third parties. Pursuant to best practices and privacy regulations, Customers should limit the amount of personally identifiable information collected to only that which is strictly necessary.
What information do we collect from Customers and why?
- We collect your name, company name, address, email address, phone number(s) and other business information.
- We use this information to provide you with our Services; for example, to confirm your identity, create your Setster Service account, contact you, provide you with advertising and marketing, and invoice you. We also use this information to make sure that we comply with legal requirements.
- We collect data about the Setster websites that you visit. We also collect data about how and when you access your account and the Setster platform, including information about the device and browser you use, your network connection, your IP address, and information about how you browse through the Setster platform.
- We use this information to give you access to and improve our Services and to make our platform interface easier to use. We also may use this information to provide you with advertising or marketing.
- We collect personal information about your Clients that you share with us or that Clients provide while booking an appointment.
- We use this information to provide you with our Services and so that you can book appointments and use the features provided within the Service.
- We will also use personal information in other cases where you have given us your express permission -- for example, when contacting us via any channel we provide, we use certain personal information to communicate with you regarding your requests or help identify you and your concerns.
When do we collect this information?
- We collect personal information when you sign up for our Services, when you access our Services or otherwise provide us with the information.
When and why do we share this information with third parties?
- Setster works with a variety of suppliers to help provide you with our Services and we may share personal information with them to support these efforts.
- We may also share your information in the following circumstances:
- to prevent, investigate, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service or any other agreement related to the Services, or as otherwise required by law.
- to help us conduct marketing and/or advertising campaigns.
- to conform to legal requirements, or to respond to lawful court orders, subpoenas, warrants, or other requests by public authorities (including to meet national security or law enforcement requirements).
- Personal information may also be shared with a company that acquires our business,
whether through merger, acquisition, bankruptcy, dissolution, reorganization, or other similar transaction
or proceeding. If this happens, we will post a notice on our website.
3. Information from Clients
Clients shall refer to an end consumer using the Services to schedule or modify appointments, provide feedback or submit a form, or utilize any other aspect of the Services that is offered by the Customer using the Setster Services.
What information do we collect from clients and why?
- We collect our Customers’ clients’ name, email, address, company name, phone number, IP address, payment, information requested during appointment booking, information about the Setster-supported Customer booking pages that you visit, and information about the device and browser you use.
- We use this information to provide our Customers with the Services, including supporting and processing appointments, authentication, and payments. We also use this information to improve our Services.
- We use some of the personal information you provide us to conduct some level of
automated decision-making -- for example, we use certain personal information (for example, IP addresses)
to block certain activities for a short period of time.
When do we collect this information?
- We collect this information when you use or access a booking page that uses our Services, such as when you visit a Customer’s site, book an appointment or fill a contact form on a Customer’s site that is using our Service.
When and why do we share this information with third parties?
- Setster works with a variety of suppliers to help provide our Customers with the Services and we may share personal information with them to support these efforts.
- We may also share your information in the following circumstances:
- to prevent, investigate, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service or any other agreement related to the Services, or as otherwise required by law.
- If the Customer whose booking page you visit, or access directs us to transfer this information (for example, if they enable a Third Party Applications that accesses Client personal information or uses our API or data export tools to transmit this personal information to any third parties themselves).
- to conform to legal requirements, or to respond to lawful court orders, subpoenas, warrants, or other requests by public authorities (including to meet national security or law enforcement requirements).
- Personal information may also be shared with a company that acquires our business
or the business of a Customer who collected your information, whether through merger, acquisition,
bankruptcy, dissolution, reorganization, or other similar transaction or proceeding. If this happens to our
own Service, we will post a notice on our website.
4. Information from Setster website visitors
"Visitor" shall refer to any person or device that connects to Setster's Website and Services as a whole.
What information do we collect from visitors and why?
- As you visit, or browse the Setster websites, we collect information about the device and browser you use, your network connection, your IP address, and information about the cookies installed on your device. We also collect personal information submitted by you via any contact form or feature available from within any of our Services, or make other requests to Setster via any of our websites.
- From telephone support, we collect your phone number, call audio, and other personal information you provide us during our call. Pursuant to our Terms of Service, we may request additional documentation from you during our call to verify your identity.
- From chat support, we collect your name, email address, information about the
device and browser you use, your network connection, your IP address, chat transcript, and other personal
information you provide us during our chat. Pursuant to our Terms of Service, we may request additional
documentation from you during our chat to verify your identity.
- From support portal, we collect your name, email address, website URL, information
about the device and browser you use, your network connection, your IP address and other personal
information you may include.
We use this information to verify your account, to provide and enhance our Services (including supporting or servicing your account, if applicable), and answer any questions you may have regarding our Services.
When do we collect this information?
- We collect this information when you visit the Setster websites, use Services
offered on our websites or engage with us either by email, web form, instant message, phone, or post
content on or through our websites (including forums, blogs and via any Messaging Feature). We also collect
any additional information that you might provide to us.
5. Information from cookies and similar tracking technologies
What is a cookie? A cookie is a small amount of data, which may include a unique identifier. Cookies are sent to your browser from a website and stored on your device. We assign a different cookie to each device that accesses our website.
Why does Setster use cookies and similar tracking technology?
- We use cookies to recognize your device and provide you with a personalized experience on our websites, or otherwise through the Services. We also use cookies as part of the Services, for example to operate the booking for our Customers, or to keep you logged into your account and store your preferences.
- We also use cookies to serve targeted ads from Google, Facebook, Bing, and other third-party advertising tools.
- These third-party advertising tools use cookies to track your prior visits to our
websites and elsewhere on the Internet in order to serve you targeted ads.
- Opting out: You can opt out of targeted ads served via specific third party
vendors by visiting the Digital
Advertising Alliance.
- We may also use web beacons, tracking technology and other automated tracking
methods on our websites, in communications with you, and in our products and services, to measure
performance and engagement as well as offer our Services.
- Please note that "Do Not Track" signals from your browser may lead to
reduced or inactivity of Service functionality and or an unsatisfactory user experience and in order to
make sure we offer the best Service we do not alter our data collection when we detect such signals.
- Cookies are stored on your device to assist us in providing and improving our
Services. For example, we use cookies to keep you logged into your account and we use data collection
devices such as Google Analytics to help analyze our web page flow, measure promotional effectiveness and
to provide you with information relevant to your interests.
- Through first-party and third-party cookies, third parties may collect information
about you while you are visiting Setster-hosted booking pages and other websites. They may use this data to
show you advertisements on Setster hosted booking pages and across the Internet based on your prior visits
to these sites. We do not collect this information or control the content of the advertisements that you
will see.
6. Third Party Applications
- Setster’s platform allows Customers to connect their accounts with Third Party Applications to alter or provide new functionalities in their account or outside of their account. These applications are all available within the Setster Service. Setster is not responsible for and has no control over how these applications function. Customers ultimately can control which applications they choose and are responsible for making sure that they do so in compliance with relevant privacy and data protection requirements.
7. What do we do with your personal information, and how long do we keep it?
- How long we retain your personal data depends on the type of data and the purpose for which we process the data. We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Notice unless a longer retention period is required or permitted by law.
- In general, we will continue to store archived copies of your personal information for legitimate business purposes and to comply with the law, except when we receive a valid erasure request or, if you are a Customer, you terminate your account and your information is purged pursuant to our standard process.
- We will continue to store anonymous or anonymized information, such as website visits, without identifiers, in order to improve our Services.
8. What we don’t do with your personal information
- We do not and will never share, disclose, sell, rent, or otherwise provide personal information to other companies, other than to specific Setster Customers you are interacting with, or to Third Party Applications being used by the Customers you are interacting with for the marketing of their own products or services, or application used to offer this Service as a whole.
- If you are a Customer using Setster’s Services, we do not use the personal information we collect from you or your Clients to independently contact or market to your Clients. However, Setster may contact or market to your Clients if we obtain their information from another source, such as from the Client themselves (for example, if they contact us directly requesting support or information regarding our Service).
9. How do we keep your personal information secure?
- We follow industry standards on information security management to safeguard sensitive information. Our information security systems apply to people, processes and information technology systems on a risk management basis.
- Though we have implemented these measures designed to secure your personal information, no method of transmission over the Internet, or method of storage is 100% secure. Therefore, we cannot guarantee the absolute security of your personal information. You acknowledge that you provide your personal information at your own risk and that you're not obliged to do so.
10. Residents of the European Economic Area ("EEA")
Setster works with Customers, Clients and Users around the world, including in the EEA. If you are located in the EEA, be advised your personal information is processed by Setster in the United States of America. As part of our Service, we may transfer your personal information to other regions.
If you are located in the EEA, you have certain rights under European law with respect to your personal data, including the right to request access to, correct, amend, delete, or limit the use of your personal data. If you are a Customer, or a Visitor of Setster’s websites and wish to exercise these rights, please reach out to us using the contact information below. If you are a Client who interacted with Customers and wish to exercise these rights, please contact the Customers you interacted with directly -- we serve as a processor on their behalf and can only forward your request to them to allow them to respond.
Additionally, if you are located in the EEA, we note that we are generally
processing your information in order to fulfill contracts we might have with you (for example if you make an
appointment through the service), or otherwise to pursue our legitimate business interests listed above,
unless we are required by law to obtain your consent for a particular processing operation.
11. Residents of California
The California Consumer Privacy Act ("CCPA") - effective as of January 1, 2020 - regulates how we handle personal information of California residents and gives California residents certain rights with respect to their personal information. Setster is both a "business" and a "service provider" under the CCPA. This section of the privacy policy applies to information we collect in our role as a business - this is when we interact directly with you. When we act as a service provider (for example, by providing our services to another company that you interact with), we follow the instructions of the business that engaged us with respect to how we process your personal information. If you would like more information about how your personal information is processed by other companies, including companies that engage us as a service provider, please contact those companies directly.
California law requires us to disclose certain information regarding the categories of personal information we collect. The following is a list of all categories of personal information which Setster collects, or has collected, from California Residents, in the twelve (12) months prior to the effective date of this Privacy Policy.

For each category of information, we collect data from a variety of sources, including directly from you, from your devices, from your social media profiles, and/or from third party providers. We collect the information to provide you with services, protect our customers and ourselves (including the services), and to improve the services. We do not share personal information with Third Parties as the term is defined under the CCPA. We do not sell personal information of any individual, including personal information of minors under 16 years of age.
You may have certain rights with respect to your personal information, including:
- The right to access, including the right to know the categories and specific pieces of personal information we collect;
- The right to deletion of your personal information, subject to certain limitations under applicable law;
- The right to request disclosure of information collected;
- The right to disclosure of information disclosed for valuable consideration; and
- The right not to be discriminated against for exercising certain rights under California law.
To exercise these rights, please submit a request by contacting us at the email address below. Please be as specific as possible in relation to the personal information you wish to access. Once we receive your request, we will review it, determine whether we can verify your identity, and process the request accordingly. If we need additional information to verify your identity, we will let you know. We will respond to your request within 45 days of receipt, or notify you if we require additional time.
12. Control over and access to your personal information
Setster understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are a Customer, you can update many types of personal information, such as names or contact information, directly within your account settings. If you are unable to change your personal information within your account settings, or if you are concerned about data collected as you visit Setster’s websites or use our Services, please contact us to make the required changes. If you are a Client who interacted with a Customer, and wish to exercise these rights, please contact the Customers you interacted with directly -- we serve as a processor on their behalf and can only forward your request to them to allow them to respond. It’s important to remember that if you delete or limit the use of your personal information, the Services may not function properly.
